End-User License Agreement

Thank you for trying out Mac HelpMate program (the "Software"). You may install, use, access, display and run any number of copies of the Software on any number of computers, such as workstations, terminals, or other devices. Having the Software installed on all your computers, ready for use, will save you time in preparing for any remote support sessions. The Software costs you nothing.

You may store any number of copies of the Software on a storage device, such as a network server or other backup medium such as a CD-ROM disc and external hard drive. You may NOT redistribute the Software outside of your company or any component thereof via a public server of any kind, including, but not limited to http (web) servers on the Internet.

THE SOFTWARE IS PROVIDED "AS IS" WITH NO WARRANTIES WHATSOEVER, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. ROSAI CONSULTING AND THE THIRD PARTY WHO MAKES THE SOFTWARE, EXPRESSLY DISCLAIM TO THE FULLEST EXTENT PERMITTED BY LAW ANY WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR ANY PARTICULAR PURPOSE, TITLE, OR ANY OTHER WARRANTY, NO MATTER HOW SUCH WARRANTY IS ALLEGED TO HAVE ARISEN. ROSAI CONSULTING AND THE THIRD PARTY WHO MAKES THE SOFTWARE DISCLAIM ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE THE SOFTWARE.

UNDER NO CIRCUMSTANCES SHALL ROSAI CONSULTING AND THE THIRD PARTY WHO MAKES THE SOFTWARE BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR OTHER DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS, DAMAGES BASED ON THE LOSS OF OR DAMAGE TO ANY RECORDS OR DATA OR YOUR COMPUTER SYSTEM, OR DAMAGES BASED ON A THIRD PARTY CLAIM) ARISING IN CONNECTION WITH THE DOWNLOAD AND/OR USE OF SOFTWARE OR SOURCE CODE, HOWEVER CAUSED AND NO MATTER THE THEORY OF LIABILITY, EVEN IF ROSAI CONSULTING AND THE THIRD PARTY SOFTWARE PROVIDER HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
